Process Server Trespassing In Michigan? Not any more…
Process servers in Michigan pull together with Michigan Congress and create clarification of law on trespassing. This law protects process servers from illegal trespassing laws which helps process servers prosecute assault charges.
State Sen. Rick Jones, R-Grand Ledge, the bill’s sponsor, said the amendment closes a loophole that allowed people trying to avoid service of court documents to erect a “no trespassing” sign that police officers often interpreted as applying to process servers.
“Police thought the law was kind of gray and usually didn’t take action,” Jones said. “This clarifies it to everybody.
“There were some people who get sued a lot who were using the trespassing signs to avoid service.”
Jones explained that the new law makes it clear that process servers are not trespassers when performing their duty of trying to serve documents. “They have the right to go from the street to the front door and back to the street, and they are not violating any trespassing law. So if somebody acts in a violent manner, they will be violating the law,” he said.
In Michigan, trespassing is a misdemeanor punished by up to 30 days in jail and a $250 fine.
