This is a great story about process service in the St. Louis area.
I think as a process server most if not all of us have had that one story about that one guy who, let say, threw a tuna at the process server and ran to avoid service. But the story that I have is about a secretary at a pediatric office. This secretary refused to fax over medical records to a law firm in Clayton, Missouri. So the firm decided to serve a subpoena on them to provide the medical records to trial the following Monday. When I entered the pediatrics office there were 3 mothers with their children aged about 0-8. I walked up to the receptionist and asked to see the custodian of records for the facility. She said “I am the custodian, but i am off work and you cant serve me.” I promptly handed her the papers and told her that “you are served” and she began cussing at me in front of the children. So I left out the front door. She followed me out to my vehicle where she wanted to confront me about how my service was not proper. I noticed her coming out of the building when i had my keys in the door lock. I was in trying to get into my car to avoid conflict. I was shutting my car door when she stuck her hand into my car door opening. I caught her arm in my car door as she was attempting to fling the paper into my face and i was attempting to shut my door so she could not strike or injure myself. I then left the scene dropping the papers out my door by the custodian of records as she was on the phone. This was considered proper service and no charges were filed.
